T&C private sessions

Article 1. Definitions
In these terms and conditions, the following definitions apply:

  • Therapist: Nuno Azevedo, Embodhi

  • Client: The individual, business, or entity commissioning the performance of work.

 

Article 2. Applicability of These Terms
These terms and conditions apply to all agreements between the therapist and the client, as well as any resulting obligations, and to all services performed and rendered by the therapist to the client. Deviations from these terms are valid only if explicitly confirmed in writing by the therapist. These terms also apply to additional assignments and follow-up assignments by the client. The terms are provided to the client upon entering into the agreement or sent via email.

Article 3. Agreement

  1. The agreement is established upon the therapist's written confirmation of accepting the client's written or verbal request or upon the commencement of the agreement's execution by the therapist.

  2. The therapist's rates for individual sessions are exempt from VAT where applicable.

  3. The agreement is based on the information available to the therapist at the time of its conclusion.

Article 4. Execution of the Agreement

  1. The agreement entails an obligation of effort on the therapist's part, not a result obligation, with the therapist performing tasks with reasonable care and professional standards.

  2. The therapist adheres to applicable guidelines and the NWP Professional Code.

  3. If the treatment is unsuitable or insufficient, the therapist commits to appropriately referring the client to a colleague or doctor.

  4. The therapist is not liable for damages resulting from incorrect or incomplete information provided by the client unless the inaccuracies were or should have been apparent.

  5. Acupuncture and complementary treatments are an addition to conventional medicine, not a substitute. Clients must consult their GP for health complaints.

Article 5. Rates
The therapist's rates may be adjusted annually as of January 1 in line with relevant cost increases. Clients will be notified of any changes two months in advance.

Article 6. Contract Duration and Termination
Agreements are entered into for an indefinite period unless a specific period or number of sessions is explicitly agreed upon.
Either party may terminate the agreement orally or in writing, with a concluding session to finalize the therapeutic process.
Treatment may be terminated at any time with mutual consent.

Article 7. Confidentiality

  1. The therapist is obligated to maintain confidentiality regarding all information entrusted to them in their professional capacity or information that they recognize as confidential.

  2. Confidentiality continues after the therapeutic process ends. Information sharing with colleagues or the client’s doctor requires written consent. Further sharing requires additional explicit written permission. Confidentiality may only be breached in cases of:

  • Client’s explicit consent

  • Legal requirement or court order

  • Conflicting duties, e.g., emergencies involving significant harm or danger (e.g., child abuse or life-threatening situations).

  • The therapist must inform the client of any breach when possible.

  • The therapist is relieved of confidentiality obligations to the extent necessary for their defense in client-initiated complaints or legal actions.

  • Third-party presence (e.g., interns) requires prior client consent.

  • The client has the right to access their own file.

 

Article 8. Intellectual Property
Recordings made by the client during sessions may be used for personal treatment purposes but must be destroyed before the next session and no later than six weeks after recording.

Article 9. Invoicing and Payment

  1. Costs for individual sessions are listed on the website. Sessions exceeding 20 minutes overrun will be charged in half-hour increments; sessions exceeding by less than 20 minutes will not incur extra charges. The therapist invoices after services are performed.

  2. Payments must be made within 14 days of the invoice date.

  3. Failure to pay on time will result in statutory interest, collection fees, and possible suspension or termination of services until full payment is made.

Article 10. Liability

  1. The therapist is not liable for damages arising from their services unless the client proves intent or gross negligence.

  2. For agreements longer than six months, liability is limited to the invoice amount for the last six months.

  3. Liability for personal or material damage is limited to the payout amount from the therapist’s liability insurance.

  4. While the therapist acts with care, minor injuries like bruising or swelling may occur; their management falls under the client’s risk.

Article 11. Cancellation

  1. Sessions may be rescheduled without cost up to 24 hours in advance.

  2. Cancellations or rescheduling within 24 hours or no-shows will incur the full session fee.

Article 12. Personal Data
By entering into an agreement, the client consents to the therapist processing personal data obtained from the agreement. The data will only be used for the agreed assignment and the therapist's activities. Information shared for research or publications will be anonymized.

Article 13. Code of Conduct
The therapist and client must behave respectfully. Offensive behavior may result in the client being denied access to the premises.
In emergencies, clients must follow instructions from the therapist or authorities (e.g., police, fire department).
The therapist is not responsible for theft or damage to property in or around the premises.

 

Article 14. Complaints and Dispute Resolution
Dutch law applies to these terms and the obligations between the therapist and client.

Terms & Conditions for Retreats & Events

Article 1. Securing Your Place and Deposit

  1. 
To qualify for the Early Bird discount, full payment must be received by the date specified on the retreat or training page. After this deadline, the regular fee will apply.


  2. A non-refundable deposit of 50% of the total cost is required to process your application. Payment methods include Debit or Credit Card, iDeal, or Bank Transfer. Detailed payment instructions will be provided via email.


  3. Your spot will be secured upon receipt of the deposit. If your application is not accepted, the deposit will be refunded. In all other cases, the deposit is non-refundable and will be applied toward the total cost.


  4. Full payment is due at least 60 days before the retreat or training start date. Participants must clear any remaining balance by this deadline.


  5. For applications submitted within 59 days of the start date, specific arrangements will be made to ensure full payment is completed prior to the retreat or training.

Article 2. Refund Policy and Cancellations


  1. Embodhi reserves the right to cancel any retreat or training. In such cases, participants will receive a full refund.


  2. If the full retreat or course fee is not received by the specified due date (28 days before the start), the participant’s spot may be reassigned, and the deposit forfeited.


  3. Withdrawal policies:

  • If a participant withdraws 15 days or more before the start date, they may transfer to a future session or receive a refund of payments made, excluding the non-refundable 50% deposit (not applicable to retreats).

  • Travel costs, including flights and transfers, are non-refundable. Participants are advised to purchase travel insurance to cover unforeseen circumstances.


  4. Refund Policy:

  • 90 days or more prior: 100% of the payment may be applied to another training.

  • 60–89 days prior: 75% of the payment may be applied to another training; 25% of the fee will be forfeited.

  • 15–59 days prior: 40% of the payment may be applied to another training; 60% of the fee will be forfeited.

  • Less than 14 days prior: No refund will be provided.

 

Article 3. Commitment for Trainings Only

By participating in a training, you agree to:

  1. Attend 100% of the classes and arrive on time.

  2. Collaborate with the Embodhi team to make up missed contact hours due to sickness or other circumstances to achieve certification.

  3. Show respect to teachers and fellow trainees.

  4. Prioritize this intensive experience in terms of energy and time.

  5. Take responsibility for your emotions, thoughts, and actions.

  6. Complete all pre/post-course requirements, including the final written assessment and live demonstration.

  7. Understand that certification is contingent upon fulfilling all course requirements and is not guaranteed solely by payment of tuition.

 

Article 4. Health or Injury Issues

  1. 
Participants retain full control over their physical activities and accept responsibility for any harm, including injury or discomfort, incurred during the retreat or training.


  2. Embodhi assumes no liability for injuries or illnesses that may occur during the event.

  3. Participants must abstain from alcohol, drugs, or engaging in illegal activities during the retreat or training and comply with the laws of the host country

  4. Pregnant participants acknowledge participation is at their own risk and that of their unborn child/children.
